Article 1: Domains and Conditions of application

These sale terms are applying to any order placed on the website www.cocooncenter.co.uk

Cocooncenter reserves the possibility to change at any moment these General Sale Terms. In this case, the conditions in effect will be applied to each order. Any client who will have placed an order on www.cocooncenter.co.uk is thus considered as accepting without reserve the General Sale Terms.

Article 2: Contract

2.1. Conditions to place an order

You declare that you are over the age of 18, and having the legal capacity or holding a parental authorization allowing you to place an order on the website.

Any order that is placed on the Website must correspond to the usual needs of the household. In this framework, and in agreement with certain of our suppliers, the number of certain references per parcel can be limited.

2.2. Steps for the conclusion of the contract

After placing your order, you will receive an e-mail from our services, confirming the items of your order.

We inform you by e-mail that your parcel has been dispatched. This e-mail accounts for our acceptance of your order and thus forms the Sale contract between You and Us.

These steps of conclusion of the contract are applicable irrespective of the proceedings for buying on the Website.

Article 4: Availability of the products

Our products are proposed in the limit of the available stocks.

If one or several of the products that you have ordered are out of stock, www.cocooncenter.co.uk is commiting to:

  • Inform you by e-mail or by phone as soon as possible
  • Propose you other items which would be likely to interest you
  • Pay you back, if necessary.

Article 5: Products price

The prices of our products are in euros and include all taxes (VAT) excluding the costs of processing and shipping (see costs). You can change the currency but this is only indicative. The payment of your order will be made in euros.

For orders destined to countries other than metropolitan France, you are the importer of the concerned products. For all products shipped outside of the European Union and overseas territories, the price will be automatically calculated excluding taxes.

Prices may be changed at any time without notice. However, the products will still be charged at the rate prevailing at the time of the order.

Article 6: Order

You can place your order only by internet, on the website www.cocooncenter.co.uk.

An order is reputed placed on cocooncenter.co.uk and the General Sale Terms accepted as soon as you clicked on the button «Validate» for a Credit Card payment, or «Buy Now» if you want to pay with paypal.

Cocooncenter.co.uk and our secure payment provider record data, which will constitute the proof of the type, of the contents and the date of the order.

In case of unavailability of the ordered product, we will inform the client as soon as possible. It will be then possible for this client either to change the contents of the order, or to cancel it.

Cocooncenter.co.uk reserves the possibility to refuse to honour an order, from any client who would not have payed the whole or a part of a previous order, or with whom a payment litigation would remain.

Article 7: Custom Duties

Any order placed on the website and delivered outside of the European Union may be subject to taxes and customs duties which are charged to the Customer when the package reaches its destination. By placing an order on the website for delivery outside the European Union, you acknowledge having read the customs rules applicable to your order's delivery : any customs duties and taxes related to delivery outside the European Union are at your sole expense and are your sole responsibility. We are not required to verify and inform you of applicable customs duties and taxes. To find out about them, we advise you to check with the competent authorities in your country.

Thus, by placing an order on the website for delivery outside the European Union, you will be deemed to be an importer. Dhygietal is exempt from any liability in the event of the blocking of goods occurring at the time of customs clearance on the grounds that the order does not comply with the import rules of the country of destination and/or that the information relating to the Customer's contact details has been erroneously completed by the Customer.

In the case of an order denied during customs clearance and sent back to Dhygietal, the return shipping costs will be considered additional costs for the Customer, which cannot be calculated in advance and will be charged by Dhygietal on the final price of the Customer's refund order.Also, in the case of an order denied during customs clearance and sent back to Dhygietal and when the customer's order products suffer damage and/or alterations; during the return, the damage suffered by Dhygietal will be considered additional costs for the Customer, which cannot be calculated in advance and will be charged by Dhygietal on the final price of the Customer's refund order.

Note: customs clearance may cause a delay in the delivery of your order.

Article 8: Payment

Make the payment of your order online:

  • On the Website of Crédit Agricole with a credit card : Visa, Mastercard/Eurocard, American Express
  • By Paypal connexion to Paypal website, via cocooncenter.co.uk

Article 3: Presentation of the products

Cocooncenter.co.uk shall not be held liable for possible mistakes concerning the product's descriptions, formulations or directions for use. The pictures and graphic design do not have any contractual value and can not be a cause for the cancellation of an order.

Article 9: Anti-Fraud Control

In the framework of the control of the orders, our customer service can also control your order before its finalization. Indeed, these controls can be necessary to protect Cocooncenter.co.uk from improper practices made by cheaters. At the moment of the control process, the customer service can be led to demand you all the necessary documents to placing an order: proof of domicile, address and telephone number, identity card or something else.

Article 10: Dispatching and delivery

Cocooncenter.co.uk commits itself into dispatching the orders under 24/48 business hours. In case of impossibility (out of stock, …), we will advise the client as soon as possible.

In the case of an order containing items with a different delivery time, the order's delivery time will correspond to the longer one among the items of the order. In this case, Cocooncenter reserves the right to divide the shipments.

The products ordered on cocooncenter.co.uk are delivered in Metropolitan France, DOM-TOM, European Union and International.

The delivery is made at the address given at the moment of the order placement. The consumer is responsible for checking the state of the package on delivery, and to indicate the possible damages to the carrier by writing it ion the delivery order, but also to Cocooncenter.co.uk, within a 2 business days deadline.

As far as the dispatching is concerned, we are working with Colissimo and Chronopost, 2 shipment services of La Poste. Colissimo is a service of fast delivery (Metropolitan France: 48H). Chronopost is a service of express delivery (Metropolitan France: 24 H delivery before 6:00 p.m.).

Cocooncenter.co.uk shall not be held liable for a delivery delay, because we depend on La Poste or Chronopost. Any wrong, missing, and yet necessary mention in the client's delivery address and identity releases cocooncenter from the responsibility of the delivery. In case of a return of the parcel to us, because of an incomplete address (ex: residence, block number, society name, etc...), the costs related to the re-dispatching of the parcel are at the client's charge.

Article 11: Period of withdrawal and return

In application of the article L.121-20 from the Code of Consumption, you have 14 days from the reception of the parcel, to return it to us if the products were not suitable for you. You are responsible for the delivery charges of the return. The items will have to be sent back complete, in their original package. We will not take and pay back any item that will be sent back incomplete, damaged, broken, or soiled.

In accordance with the article L.121-20-1 from the Code of Consumption, the item(s) that will be sent back will be payed back to you within 30 days according to the date on which this right was exerted.

Article 12: Ownership Statement

The items delivered will remain ours until the client has fulfilled all the obligations towards us, and in particular until the whole payment is completed.

Article 13: Processing of personal and confidential data

Your identity, address, e-mail address, phone number, and so, are not given to any other society without your consent.

Cocooncenter.co.uk is declared to the CNIL (French National Commission of Computers and Liberties) under the number 1145673. Our declaration to the CNIL guarantees your rights, which are quadrupled:

The sale of all Pierre Fabre Laboratory ranges (Aderma, Anne de Péraudel, Avène, Ducray, Elancyl and Klorane) is limited to the European Economic Area. Any sale placed outside of this economic area will be immediately refunded.

The sale of all Cosmétique Active Laboratory ranges (Vichy, La Roche-Posay, Decléor, Sanoflore and SkinCeuticals) is limited to the European Economic Area. Any sale placed outside of this economic area will be immediately refunded.

The sale of all Bioderma Laboratory ranges is limited to the European Economic Area. Any sale placed outside of this economic area will be immediately refunded.

Article 17: Assignment of jurisdiction

The General Sale Terms below are governed by the French Law. Any protest about these General Sale Terms will be subjected to the bankruptcy court of Châlons-en-Champagne FRANCE, only.

These General Terms and Conditions of Membership set the terms of membership and operation of the loyalty program «Cocoon & you». Membership in the program implies full knowledge and acceptance of these General Conditions of Membership and apply from 12/06/2023.

TERMS AND CONDITIONS FOR MEMBERSHIP IN THE "Cocoon & you" LOYALTY PROGRAM

Membership in the Program is free and takes place exclusively online at the various shops in France, the United Kingdom, Spain, Belgium, Germany and Italy. To register for the Program and take advantage of its benefits, you must have a customer account, open an account and place a first order automatically leading to membership in the Program.

Only one membership per person will be counted. Membership is strictly personal, only the Member who has joined Cocoon & you can benefit from the benefits described below. Use by any other person is prohibited and cannot be accepted. It is not possible to transfer your points, benefits and rewards from one account to another and each account is exclusively linked to its creation store.

The "Cocoon & you" Program is completely dematerialized, no physical support will be given to you.
You will automatically be part of the "Cocoon & You" program when placing your first order to enjoy exclusive benefits.

EARNING POINTS

With each of your purchases of Products (excluding shipping costs), you accumulate points according to the following scale: 1€/£/$ including taxes = 10 points.
When purchasing on the Site, the amount of your purchases will automatically be converted into points that will be credited to your account.
Points are credited upon shipment of your order and are valid for 1 (one) year from the date they were credited.

In case of exchange or refund of a product, the number of points related to the purchase of this product will be deducted from the balance of your points.
Points cannot be sold or exchanged for cash.

You can freely view the number of points earned directly on your online customer account. Additional points may be earned for special operations.

Rounding:
From 0.01 cents to 0.49 cents, the rounding is done below. Thus, if the amount of purchases is 56.25€/£/$ = 560 points, From 0.50 cents to 0.99 cents, the rounding is above.
Thus, if the purchase amount is 56.50€/£/$ = 570 points.

OBTAINING REWARDS

You can redeem your points for rewards. Depending on the number of points you have, you can choose a product in the catalog «Cocoon & you» available in the cart during a next order;

No item other than those in the catalogue may be given to the Member.

Products purchased under the Cocoon & You Program are not exchangeable or refundable. Dhygietal cannot be held responsible in case of unavailability of certain Products and may at any time substitute a product by another and/ or remove a level giving access to a product.
